## 28. The Mosaic Legislation

[¶0] The book of Deuteronomy was "found" by the high priest Hilkiah.[E134] 35 In other words it was compiled by the clergy, and precisely by that part of it which was imbued with the principles of Isaiah and Jeremiah.

35

[¶1] It is not known for certain whether the Jews had any written codes of law before that time. Amos, true, says that Jehovah gave Israel "important laws", which, however, are not observed.[E135] Since ritual laws did not seem at all important to the Tekoa shepherd, one must think that these were moral and social laws, drawn up in a more ancient period and having in general a Yahwist character — that is, defending the equality of primitive agricultural economy[E136] and the patriarchal strictness of morals.[E137] 36 In any case Deuteronomy was the first complete legislative book; from it there developed the whole Mosaic legislation, written down in the books of Exodus and Leviticus probably in the times of Ezra.

[¶2] Deuteronomy is the highest of the legislative books. The spirit of Isaiah still breathes over it in all its purity. It is natural that the prophetic party, in order to give this work greater force, ascribed it to the man who had led the people out of Egypt, who had been the first great prophet of Jehovah, the patron of the whole tendency. The Mosaic legislation discloses to us the social-economic programme of the prophets. It proceeds in the ideal from the equality of landed property — that is, from its division on equalising principles. But knowing well from experience that an equalising division inevitably leads within a certain term to inequality, to the wealth and power of some and the poverty and slavery of others — the legislator adopts a series of decisive measures.

[¶3] It is impossible to characterise these measures better than by citing the enthusiastic praises of the leader of the supporters of the nationalisation of land in our own time.

[¶4] "Trace that cause which produces want amid abundance, ignorance amid education, an aristocracy amid democracy and weakness amid growing forces, which bends our civilisation towards a one-sided and unstable development, and you will notice that it is rooted precisely in what this great statesman already discerned and attempted to remove three thousand years ago. Moses saw that the true cause of the enslavement of the popular mass in Egypt — the cause everywhere leading to enslavement — was the passing into the ownership of one class of the land from which and on which all men must live. He saw that to admit in relation to land that very unlimited right of property which is naturally applied to the products of human labour would mean inevitably to divide the people into the very rich and the very poor; it would mean inevitably to enslave the labourers, to make a few masters over the many, whatever the forms of government might be, to evoke vice and moral degradation, whatever the religious beliefs might be.[E138]

[¶5] And with the foresight of a philosopher and a true statesman, who writes laws not for the needs of a single day but for an endless series of generations to come, he strives to forestall this false step by the method that seemed to him suited to the conditions of place and time. Everywhere in the statutes of Moses the land is regarded as the gift of the Creator to all His creatures without distinction, which no one has the right to seize into his exclusive possession. Nowhere is it spoken of as your estate, your property, the land which you bought or conquered, but everywhere it is called the land "which the Lord thy God giveth thee to possess" — the land "which the Lord giveth thee for an inheritance".[E139]

[¶6] And by way of practical legislation, with the help of enactments having the highest sanction, he tried to prevent that injustice which turned the ancient civilisations into hotbeds of despotism, that injustice which in later centuries ate the heart out of Rome, gave birth to the insane serfdom of Poland and to the terrible ruin of Ireland — the injustice which herds working families in the cities into stinking slums and fills our new states with vagabonds. He provided not only for the just division of the land among the people and for leaving the land free and in communal use every six years, but also established jubilee years and provided for the redistribution of the land every forty-nine years, thereby making its monopolisation impossible."[E140] 37

[¶7] In their social-economic programme the prophets were supporters of democratic justice, even at the price of the fall of culture. Leo Tolstoy, their faithful disciple, is a pure Mosaicist. But the Socialist-Revolutionaries too are an offshoot of the same root. And it is understandable. The ideology of the small property-owner struggling against capital is always one and the same: artificially to hold back the forward course of inequality. The consciousness of the necessity of capitalism as a cultural force is inaccessible to the small property-owner: "I humbly thank you for your culture, Mr Marx, I bow to your economic rod, but I have no intention whatever of building a bridge for culture out of my own bones."[E141] But the sorrowful bridge is being built all the same. And there is no other bridge to the victory of true justice. It will come down upon the earth — or rather it will blossom on it only on the soil of wealth; and for that labour must be organised, and labour can be organised only by the colossal enterprises of private rich men, of companies or of the state. If God existed, he ought to be cursed for this one abyss alone, which humanity fills up with its own corpses. But there is no God; there is inexorable nature, which does not pander to us. It must be conquered. Sufferings are inevitable. One may try to ease them, but to go backwards, terrified by this cup[E142], is both cowardly and vain.

[¶8] The prophets had a great justification: the culture of their time, though it had artistic and scientific value, did not promise imminent liberation.

[¶9] For the Tolstoyans there is no such justification. They are justified only by their historico-philosophical blindness. As for the Socialist-Revolutionaries — two souls begin to struggle in their breasts in proportion as they make the object of their agitation not the peasantry alone but the proletariat too. The more intelligent, sensitive and bold will end by assimilating themselves to the supporters of scientific socialism[E143], will abandon utopias and will assist in the courageous and scientifically honest working out of the agrarian question, which is of enormous importance to socialism and still far from exhausted. The others will abide in the hopeless nets of the contradictions of the petty-bourgeois world.

[¶10] Let us return to the precious chain of the great prophets. The series of chapters beginning with LI in the book of Isaiah[E144] was written by a great prophet-poet who lived in Babylon, whither almost the whole Jewish intelligentsia had been deported after the rout of Jerusalem.

[¶11] 150 years had passed since the day of Isaiah's death, but his spirit was alive and developing. Fortune smiled again upon the long-suffering people. King Cyrus was well disposed towards it and took it under his mighty wing. And again Israel answered with rapture to fate's caress. Are the appointed times not ending? Are the joyful days of mercy not beginning? "Comfort ye, comfort ye, comfort ye my people, saith our God." (Isa. 40:1)[E145] So begins Deuteronomy.[E145] "The voice of him that crieth in the wilderness, Prepare ye the way of the Lord, make straight in the desert a highway for our God. Every valley shall be exalted, and every mountain and hill shall be made low: and the crooked shall be made straight, and the rough places plain… O Zion, that bringest good tidings, get thee up into the high mountain; O Jerusalem, that bringest good tidings, lift up thy voice with strength; lift it up, be not afraid: say unto the cities of Judah, Behold your God! Behold, the Lord God will come with strong hand, and his arm shall rule for him." (Isa. 40:3–4, 9–10a)[E145] "Behold, his reward is with him, and his recompense before him." (Isa. 40:10b)[E145] How much joy, how much exultation!

[¶12] Cyrus is glorified with enthusiasm: "Who raised up the righteous man from the east, called him to his foot, gave the nations before him, and made him rule over kings? he gave them as the dust to his sword, and as driven stubble to his bow. He pursued them, and passed safely; even by the way that he had not gone with his feet. I have raised him up from the north, and he shall come: from the rising of the sun shall he call upon my name: and he shall come upon princes as upon morter, and as the potter treadeth clay." (Isa. 41:2–3, 25)[E146]

[¶13] The prophet goes with his good tidings of the opening radiant distances first of all to the poor, following the tradition of prophecy: "The Lord hath sent me to preach good tidings unto the poor; he hath sent me to bind up the brokenhearted, to proclaim liberty to the captives, and the opening of the prison to them that are bound; to proclaim the acceptable year of the Lord." (Isa. 61:1–2a)[E147]

[¶14] In marvellous images he glorifies the near future of Jerusalem: "Arise, shine; for thy light is come, and the glory of the Lord is risen upon thee. For, behold, the darkness shall cover the earth, and gross darkness the people: but the Lord shall arise upon thee, and his glory shall be seen upon thee. And the Gentiles shall come to thy light, and kings to the brightness of thy rising. Lift up thine eyes round about, and see: all they gather themselves together, they come to thee: thy sons shall come from far, and thy daughters shall be carried in arms. Then thou shalt see, and rejoice, and thine heart shall fear, and be enlarged; because the abundance of the sea shall be converted unto thee, the wealth of the nations shall come unto thee. Who are these that fly as a cloud, and as the doves to their windows? Surely the isles shall wait for me, and the ships of Tarshish first, to bring thy sons from far, their silver and their gold with them, unto the name of the Lord thy God, and to the Holy One of Israel, because he hath glorified thee. And the sons of strangers shall build up thy walls, thy gates shall not be shut day nor night; that men may bring unto thee the wealth of the nations, and that their kings may be brought." (Isa. 60:1–5, 8–11, abridged)[E148]

[¶15] Such are the prospects of the earthly greatness and economic prosperity of Jerusalem. The times of Solomon will return, a hundredfold intensified. But it will now be the reward of righteousness, and not of the injustice of a military and commercial aristocracy. Justice will flame in Jerusalem:

[¶16] "Behold, I create Jerusalem a rejoicing, and her people a joy. And I will rejoice in Jerusalem, and joy in my people: and the voice of weeping shall be no more heard in her, nor the voice of crying. There shall be no more thence an infant of days, nor an old man that hath not filled his days: for the hundred-year-old shall die a youth; and they shall build houses, and inhabit them; and they shall plant vineyards, and eat the fruit of them. They shall not build, and another inhabit; they shall not plant, and another eat: for as the days of a tree are the days of my people, and mine elect shall long enjoy the work of their hands. They shall not labour in vain, nor bring forth for trouble; for they are the seed of the blessed of the Lord, and their offspring with them. And it shall come to pass, that before they call, I will answer; and while they are yet speaking, I will hear. The wolf and the lamb shall feed together, and the lion shall eat straw like the bullock: and dust shall be the serpent's meat. They shall not hurt nor destroy in all my holy mountain, saith the Lord." (Isa. 65:18–25, abridged)[E149]

[¶17] The emphasised words clearly express the ideal of the small property-owner — the ideal of an independent labouring peasantry and petty bourgeoisie.

[¶18] But in this is not the prophet's true greatness. His greatness lies in the marvellous conception — or rather in the extraordinarily vivid transformation of the fundamental conception of the prophets: for the humility, patience and suffering of the righteous — that is, of the poor class, the class of sufferers in a suffering people, the class innocent of the sins of pride, of acquisitiveness, of unjust judgment — for the merits of the long-suffering righteous poor man of Jewry, God will exalt his people. More than that: the measureless sufferings of the Jewish plebs will redeem all humanity. Here we meet a developed form of, so to speak, moral magic: nature depends on God, and on him therefore depends the happiness of humanity too. One must influence the will of God — that is far more important than to try to influence nature itself by labour. But to influence the will of God by sacrifices is a vain and criminal dream: not sacrifices, not rites, but the observance of social justice — that is the magical means of becoming sons of God and masters of nature.

[¶19] The famous passages relating to this were later applied to Christ and partly served as the canvas that predetermined many of the supposedly biographical features of the Gospel. The suffering Messiah — that is the great idea; the beggarly, modest, humiliated Messiah, whose words will shine the brighter for it: it is the stately, world-historical form of the tale of Cinderella, or of the ugly duckling.

[¶20] "Behold my servant, whom I uphold; mine elect, in whom my soul delighteth; I have put my spirit upon him: he shall bring forth judgment to the Gentiles. He shall not cry, nor lift up, nor cause his voice to be heard in the street. A bruised reed shall he not break, and the smoking flax shall he not quench: he shall bring forth judgment unto truth. He shall not fail nor be discouraged, till he have set judgment in the earth: and the isles shall wait for his law. I the Lord have called thee in righteousness, and will hold thine hand, and will keep thee, and give thee for a covenant of the people, for a light of the Gentiles; to open the blind eyes, to bring out the prisoners from the prison, and them that sit in darkness out of the prison house." (Isa. 42:1–4, 6–7)[E150]

[¶21] "Behold, my servant shall deal prudently, he shall be exalted and extolled, and be very high. As many were astonied at thee; his visage was so marred more than any man, and his form more than the sons of men." (Isa. 52:13–14)[E151]

[¶22] All this relates to the righteous part of the Jewish people. But Christian messianism is already created. For Paul it remains only to concretise it: in place of the symbolic servant, the "ebed of Jehovah"[E152], to put the crucified preacher of the great truths of prophecy, identified at the same time with the Son of God, having made God himself the "sacrifice of redemption", and further to add to his merits salvation from death. Of course that is a great deal. But this great deal was merely the superimposition of Greek religious representations and traditions upon the great democratic redeemer-sufferer of Deutero-Isaiah.

[¶23] We need not follow the religious destinies of the Jews further. Beginning with Ezekiel, the priestly spirit — conservative, striving to turn everything into law and letter — takes the upper hand over prophecy. Creativity comes to a standstill. The representatives of the traditions, after the aristocrats of the sanctuary had become strongly hellenised (the Sadducees), proved to be the legalists — the Pharisees.

[¶24] John and Jesus were probably a late flowering of the prophetic spirit. In their preaching the notes of spiritual freedom were heard again. But they were rejected by the inert majority. And the gentiles who accepted them, thanks to a strange confluence of destinies, made them unrecognisable. But the influence of the fundamental work of the prophets — the best part of the Bible — did not cease. The Old Testament was destined to renew itself repeatedly and at last to pour its waters into the sea of the new religion, the religion of Labour.
